Government Departments Are Not Above The Law.

Very good news for us indeed and unfortunately very bad times for little Napoleons and political Sheriff of Nottingham type thieves, when the courts delivered a big blow in favour of the layman and the private sector by serving a strong warning and harsh punishment on a local council. This prompted Minister in the Prime Minister's Department Datuk Seri Mohamed Nazri Aziz to state that government departments are not above the law. Of course we knew this all along but were unable to show or prove it. Now the courts have once again affirmed the supremacy of the people and the servility of the authorities.

"The court can decide against government departments and agencies if they broke the law", Nazri acknowledged.

He was commenting on the recent High Court's decision that was in favour of Sonati Development Corporation Sdn Bhd, which had sued the Kangar Municipal Council for breach of contract.

Nazri said that the fact that the court ordered the council to pay the company compensation of more than RM6 million proved that the country's judicial process was healthy and free from government interference.

Speaking to reporters after visiting the Suka Menanti court complex here Wednesday, he said the incident was not an embarrassment to the government but reflected the freedom of the judicial system.

Tuesday, Sonati Development Corp secured a court order to seal the council's building for failure to pay the compensation as a result of illegally terminating a contract to develop a plot of land in Titi Tinggi near Padang Besar.

Nazri said that its is the council that should be embarrassed and hoped other government departments and agencies took cognisance from the incident.

Meanwhile, in KANGAR, the council's president, Faezan Omar, said the council would not make any statement on the issue as a report on the matter was being compiled to be submitted to the state government.

Faezan is believed to have discussed the sealing incident at a meeting with Perlis Menteri Besar Datuk Seri Shahidan Kassim Wednesday.

He said that he would issue a statement when the report was ready and had been submitted to the state government.

Although the local authority's office has been sealed, it was still business as usual for the council in terms of operations.

Nevertheless, security guards were placed at the premises to prevent assets from being taken out from the building.
