Asset Distribution: Datuk K Gets The 'All-Clear' From Syariah Court.
The distribution of matrimonial assets between Datuk Mohamed Khalid Jiwa or Datuk K and his ex-wife, Tengku Zawyah Tengku Izham was resolved Friday after the Syariah High Court here allowed the mutual agreement signed by both parties to be enforced.
This was disclosed by syarie lawyer, Zulkifli Che Yong who represented Tengku Zawyah, 43, after the hearing in chambers.
He said Syarie Judge Hussin Ahamad ordered that ownership on two units of two-and-a-half-storey semi-detached houses in Kota Damansara, worth about RM1.8 million be given to Tengku Zawyah.
"The outstanding loan on the houses must be settled by Khalid within a period of five years while the their matrimonial home, that is, a four-storey mansion on Bukit Antarabangsa Ulu Klang, is declared as a matrimonial asset by both parties.
"The rights to the matrimonial home must be handed over to any one of their children (Mohamed Anas Zawawi, 19, Mohamed Adib, 16, Mohamed Asyraf, 14 and Mohamed Aazief, 8) chosen by Khalid when all of them have reached the age of 18. However, Tengku Zawyah has the right to live in the mansion together with their children," he told reporters.
Zulkifli said the court also allowed an additional provision for Tengku Zawyah, that is, Khalid must amicably provide additional allocation such as expenses for annual vacation, monthly alimony, insurance, medical expenses and other bills as well as maintenance cost for the house.
Meanwhile, syarie lawyer Datuk Mohamed Burok, who represented Khalid, 47, said his client received two lots of empty land at Taman Kelab Ukay, Bukit Antarabangsa, a Corinthiam condominium unit at Jalan Binjai, Off Jalan Ampang, a Bistari condominium unit, Off Jalan Putra and an office premises at MidValley Development.
According to syarie lawyer Azmi Mohd Rais, who also represented Tengku Zawyah, both parties had 14 days to comply after receiving the order signed and failure to do so would be deemed to be in contempt of the court.
On July 3, Khalid and Tengku Zawyah had signed a mutual agreement on the distribution of their matrimonial assets accumulated during their 20-year marriage.
