Dr Mahathir's Pepper Spray Assault Case Goes To Court In March 2007.

The magistrate's court Wednesday fixed March 11 to 15 to hear the case of a businessman charged with causing injury to former Prime Minister Tun Dr Mahathir Mohamad and three others in a pepper spray incident last July 28.

Magistrate Azman Mustapha fixed the date after being informed that the Attorney-General's Office had rejected a representation by the accused seeking not to continue with the charge against him.

A prominent businessman here, Datuk Nik Sapeia Nik Yusof, is charged with inflicting harm on Dr Mahathir and three others, including former Pasir Mas Member of Parliament Datuk Ibrahim Ali, by spraying a substance hazardous to the body at the Sultan Ismail Petra Airport in Pengkalan Chepa about 11am on July 28. The two others who were also affected by the spraying of the substance were Mohd Nasir Muda and Suberi Sahidan.

Earlier, Nik Sapeia's counsel, Zainal Abidin Mustaffa, applied for a re-mention of the case pending the outcome of his client's representation to the AG's Office. He told the court that the representation was sent to the AG's Office on Oct 9 and that they had received a reply on Oct 16 which stated that the matter was being considered. Zainal also said his client also wanted to apply to have the case heard in the High Court since it was a "high-profile case".

DPP Khairul Anuar Wahab, who objected to the application, said he had received a call from the AG's Office informing that the representation by the accused was rejected and a letter to that effect would be sent soon. He also objected to the case be heard by the High Court.

Nik Sapeia, who was charged on Oct 9, had pleaded not guilty to the offence and was allowed bail of RM8,500. He is charged under Section 324 of the Penal Code which carries a three- year jail sentence or fine or whipping or any of the two, upon conviction.

***** So this warlord from Kelantan arrived with bodyguards! One thing though, I admire this guys guts. Or was he being plain stupid? In full view of the public, with TV cameras on and security everywhere, he still went ahead and sprayed the Tun! That requires either testes the size of Mercedes hubcaps or the IQ of a cretin or both.

The chances of him getting away with such an abominable act, now that the case is going to court is as slim as Samy Vellu leaving public office tomorrow. The full force of the law must be brought to bear on him, not as revenge but as a severe warning and reminder that such an act is not only alien to our country and the way things are done here, but also as a deterrent to any copycat sprayers lurking in the background somewhere in Malaysia.

I think that on this issue there should be near universal unanimity. Punish the man and make him serve time. He should not just escape with a fine.
