Is Islamic Law Above The Federal Constitution?

Reading a recent Bernama report on the Lina Joy court verdict, I came across a very interesting question which was posed to the PM: (At the press conference, Abdullah also dismissed a suggestion from a foreign journalist that Islamic law was now above the Federal Constitution in the country. "There is no such thing (of Islamic law being above the Federal Constitution). The Federal Constitution is the Federal Constitution. There is a set of laws we have to follow. It is something that we have to follow, that's all," he said.)

That reply by Pak Lah was indeed reassuring that the primacy of the Federal Constitution vis a vis Islamic law is not in jeopardy and the status quo will be maintained. However does the average non-Muslim have the same confidence as the PM on the issue or does he feel that Islamic law is slowly but surely taking root here in a way that was never meant to be by our founding fathers? Are non-Muslims here being made to pay the price of Islamic resurgence the world over and is the government pandering to the innate insecurities of its Muslim citizens? More importantly, do Muslims, especially the legally ill-informed ones, accept the supremacy of the Federal Constitution or will they in the near future demand its total removal and call for the country to go down the narrow path to the 'golden days of Islam'?

Lina Joy herself feels that she has been given the short end of the stick. A vast majority of non-Muslims think so too. In my earlier post on the subject I deliberately refrained from commenting and merely published a report from Channel Newasia, in order to gauge the response and comments to a 'neutral' article. The comments flowed in and the religious divide between the two sides was glaring and the chasm between the opposing adversaries (for that's what they now really are) apparently unbridgeable. Amidst this pessimism, despite being aware of the fear, trepidation and misgivings of non-Muslims, all that the Prime Minister could bring himself to say was Accept Decision In Lina Joy Case With Open Mind. Pak Lah is walking a political and religious tightrope and the precariousness of anyone in such a position is reflective of our doubtful national solidarity as well as the religious disunity prevailing in Malaysia today.

Actually, ever since I read that very same news article, I keep wondering which "it" Pak Lah was referring to.

If the "it" in question refers to the Federal Constitution, then perhaps he still considers the Constitution to be supreme. But what if he meant the other "it"? Makes that statement means something else altogether.

In any case, I've started a straw poll on whether the general populace still thinks the Federal Constitution is supreme.

Pak Lah, is in a position that no one would envy, caught between the Scylla and Charybdis, so to speak, between being a PM for all Malaysians, and losing the Malay/Muslim vote to PAS.

Do you or all of us still believe in what Abdullah said??

He said there is no religious divide here. He is lying or still sleeping. Look at the controversy & the confrontation in the proposed Inter-Faith Committee & the forum of Article 11 group.

If the Federal Constitution is supreme as what Abdullah has claimed, then the dissenting judgement by Datuk Richard Malanjum
is correct. Lina Joy should have won the case. Whatelse?

Abdullah claimed to be the PM of Malaysian of all races. Why then he shouted "hidup melayu" in the previous UMNO AGM? Shouldn't it be "hidup Malaysian"?

He also claimed to fight corruption, have open tenders for projects etc etc. But did he really do it? Klang palace builder & close-one-eye chaps are still free out there.
Abdullah is Cakap tak serupa bikin & cakap tak bolih pakai.

Does he expect anyone to believe him! What he says is always different what he does and what happens on the ground. He is famous for never telling the truth. Remember he said his son is not involved in any business with the government? Remember he said the Independent Police Panel recommended by the Police Commission will be in force soon. Where is it? Remember he said that the method of calculating the bumi share under the NEP will be disclosed. Where is that? He has a penchant for lying! He is still lying or he does not know what he is saying. His writ does not run beyond his nose.

It is clear now that the Constitutional position of freedom of religion has been raped and violated. Is he going to do something to clarify the constitutional position? He is a coward and will pray that his islam hadhari will work. I do not trust him. The constitution has been raped by religious bigots.


Lina joy should seek and readily will obtain asylum in a more enlightened country on the ground that she is persecuted on religious grounds.

I sincerely hope Lina will have a better life in every aspects especially religious in another country; afterall malaysia is fucked-up country.
